COMPLAINTS PROCEDURE – FISG SRL

Dear Client
We wish to inform you that FISG S.r.l. (hereinafter the "Company") has established an internal complaints management department and has adhered, in accordance with the provisions of the law, to an alternative dispute resolution (ADR) entity to resolve any disputes that may arise between the Company and the client.

Submitting a complaint to the Company

In the event that a dispute should arise relating to the Company's conduct or an omission, you should first raise the issue with your usual contact person in order to resolve the complaint in a simplified manner.
Should such contact not lead to the desired result, you may submit a written complaint to the address below, using one of the following methods:
1) by ordinary post or registered letter, with or without acknowledgment of receipt;
2) by ordinary or certified email.
The complaint must contain, at a minimum, the full contact details of the complainant and a clear description of the reason for the complaint. It must be duly signed by a person with the necessary powers of attorney.
The complaint submitted to the Company and the procedural process that ensues are completely free of charge (subject to any costs associated with the sending of the complaint).
Upon receipt of the complaint, a preliminary investigation will be performed to analyse the reason for the complaint and you will be notified of the outcome of the same in writing within 30 days.

Out-of-court dispute resolution systems

If the answer provided by us is not satisfactory, it is possible, as an alternative to ordinary justice, to resort to a Banking and Finance Arbitrator (ABF - Arbitro Bancario Finanziario), a collegial body whose members are appointed on the basis of experience, professionalism, integrity and independence to handle disputes relating to the determination of rights, obligations and faculty, regardless of the value of the relationship to which they relate. If the claimant's request relates to the payment of a sum of money for any reason, the dispute falls within the jurisdiction of the arbitrator provided that the amount claimed does not exceed 100,000 euros. Claims for damages that are not an immediate and direct consequence of the failure or violation of the intermediary are excluded from the jurisdiction of the deciding body. Also excluded are matters relating to material goods or services other than those covered by the banking and financial contract between the client and the broker or contracts connected to it (for example, those related to any defects in property leased or provided through consumer credit transactions; or those related to supply associated with trade receivables sold as part of factoring transactions).
Disputes relating to transactions or actions carried out prior to January 1, 2007 cannot be submitted for arbitration.
Appeals relating to disputes already submitted to the courts, sent for arbitration or for which an attempt at conciliation is pending in accordance with the law may not be submitted.
